submittal of all necessary applications relating to: all required licenses, permits, approvals and certifi- <br />cates, impact documents and temporary easements (hereafter "Permits") relating to, necessitated by and <br />necessary or appropriate for: <br />(a) The Work or the product of said Work, the performance and completion of the Work, the overall devel- <br />opment of the Project and all other activities and obligations under the Contract Documents (whether <br />performed by Contractor or by any Subcontractor ); and <br />(b) The proper operation or use by Walmart after the completion of the Work, including all machinery, <br />equipment and fixtures to be installed by Contractor or any Subcontractor in connection with the perfor- <br />mance of the Work, in each case with said submittals to, and obtaining from, the proper authorities <br />responsible for issuing said Permits for the Project, including without limitation the building permit and <br />all other permits and governmental fees, licenses and inspections necessary for proper execution and <br />completion of the Work. <br />3.6.1.4.2 Coordination. Contractor shall coordinate with Walmart and any applicable Contractor with respect to <br />obtaining all such Permits. <br />3.6.1.4.3 Fees. See Compliance Exhibit 3.6.1.4.3. <br />3.6.1.4.4 Delays. In the event that any delay is incurred in obtaining any Permit Contractor shall immediately <br />notify Walmart, in writing, of the reason(s) for said delay. <br />3.6.1.4.5 Designation. Notwithstanding any provision to the contrary herein, Contractor shall have the right to <br />designate other persons or entities to obtain any Permit, provided, however, that any such designation <br />shall not relieve Contractor of any liability as a result of any failure to obtain any such Pennit. <br />3.6.1.4.6 Permit Availability. Contractor shall ensure that the applicable Permits are readily available at the Site, <br />or at a location properly designated pursuant to the applicable Permit or Compliance Requirements, for <br />review as appropriate. <br />3.6.1.4.7 General Contractor Permit, Registration. Notification (GCPRN) Report. Contractor receives the <br />GCPRN report in the bid documents prior to submission of the bid. The report identifies those permits, <br />registrations, notifications, inspections and/or installer certifications (PRNs) to meet environmental reg- <br />ulatory requirements. The list of PRNs is not intended to be comprehensive, but identifies those PRNs <br />that were identified during the design review process. <br />(a) Contractor shall ensure the PRNs are either forwarded to the Construction Testing Lab (CTL) Project <br />Manager for upload (if projects that include a CTL) or shall upload PRNs directly to the Walmart Work- <br />space. <br />(b) The GC may obtain additional PRNs not identified within the GCPRN. Contractor is also required to <br />provide a copy of any obtained PRNs to the CTL Project Manager or upload into the Walmart Work- <br />space. <br />3.6.1.5 RESPONSIBLE PEOPLE AND GENERAL DUTIES <br />3.6.1.5.1 General: Contractor shall enforce strict discipline and good order on the Project Site. <br />3.6.1.5.2 Project Superintendents Requirements. The Contractor shall designate the required number of Project <br />Superintendents as identified in the Contract. Proposed Project Superintendents shall: <br />(a) Hold a valid Walmart Stormwater Certificate; <br />(b) Have a level of knowledge and understanding of Compliance Laws, requirements and procedures; <br />(c) Successfully complete any Federal, State or local training program mandated by the applicable permit <br />or Compliance Laws; <br />(d) Be responsible for overseeing activities and work at the Site; <br />(e) Possess the skills to adequately identify and implement Compliance Requirements, including sediment <br />and erosion control practices; and <br />(f) Have authority to direct Subcontractors, Walmart Contractors and Workers to undertake actions to com- <br />ply with the Permits and Compliance Requirements. <br />3.6.1.5.3. Project Superintendents Responsibilities. No Work shall be performed under this Contract unless at <br />least one Superintendent is present on the Site.
