(a) <br />Stormwater: If an NPDES Stormwater Permit is required for the Project, the Superintendent shall provide <br />oversight and management of the implementation, and maintenance of the SWPPP. <br />(b) <br />Safety: Superintendent shall be responsible for maintaining general safety, the Safety Program, and pro- <br />tection against accidents, exposure to toxic or hazardous substances generated out of the course of the <br />Work, and property damage. <br />3.6.1.5.4 <br />Compliance Oversight Manager (COM) Requirements. The proposed COM shall: <br />(a) <br />Hold a valid Walmart Stormwater Compliance Certificate; <br />(b) <br />Have a level of knowledge and understanding of Compliance Laws, including Stormwater Laws, re- <br />quirements and procedures. <br />(c) <br />Successfully complete any Federal, State or local training program mandated by the applicable permit <br />(d) <br />or Compliance Laws; <br />Be able to adequately identify and implement Compliance Requirements including storm water sediment <br />and erosion control practices, <br />(e) Have the authority and ability to effectively instruct Subcontractors, Walmart Contractors, and Workers <br />in the implementation of such practices; and <br />(f) Have the authority to stop work on the Site, and direct the Superintendent and other Subcontractors, <br />Walmart Contractors and Workers in the execution of Compliance Requirements, including the ability <br />' to remove Workers for failure to comply;. <br />3.6.1.5.5 Compliance Oversight Manager (COM) Responsibilities. The COM is the individual on the Project Site <br />with overall responsibility for Compliance. This includes oversight, auditing, training and documenta- <br />tion responsibilities. Responsibilities of the COM include ensuring all "Compliance" training, plans, <br />processes and procedures required in the Contract, its Exhibits, this Compliance Exhibit and all refer- <br />enced Specifications and/or Forms, or project construction documents, are accomplished and main- <br />tained. <br />3.6.1.5.6 Competent or Qualified Person. Contractor shall ensure that Competent or Qualified persons, whichever <br />is applicable, are available per the requirements of Safety Laws for all job descriptions requiring such. <br />I For each construction discipline where OSHA or NFPA 70E requires a Competent or Qualified Person, <br />the Contractor shall evaluate candidates for competency and select a candidate that meets those require- <br />ments. <br />(a) The Competent / Qualified Person Designation Form (Attached as "Safety Forms") shall be used to <br />maintain an up to date and current log of Competent and Qualified Person(s) which includes selected <br />individual's name as well as the discipline he/she serves as the Competent or Qualified person for. <br />(b) Each selection of a Competent or Qualified Person must be communicated to all Workers on site during <br />a safety meeting. <br />(c) Qualified Person — Electrical requires: Meets standards as defined by OSHA and the latest version of <br />NFPA 70E; has a valid professional license as may be required; is working under a valid business license <br />as may be required. <br />3.6.1.5.7 Qualified Verifier. Contractor shall ensure a Qualified Verifier reviews Verification Documents on be- <br />half of the Contractor, and shall execute the appropriate WV Forms required in Sec. 3.6.5 of the Com- <br />pliance Exhibit and these Specifications . <br />Contractor shall ensure that a Qualified Verifier reviews Verification Documents on behalf of the Sub- <br />contractor(s), as evidenced by each Subcontractor's execution of the appropriate WV Forms required in <br />the Compliance Exhibit and these Specifications. <br />(a) Qualified Employee Verifier. Employee of Contractor or Subcontractor who is trained, experienced, <br />and possesses the requisite skill and knowledge to conduct a reasonable compliance review of the Veri- <br />fication Documents. <br />(b) Qualified Third Party Verifier. Any person who is trained, experienced, and possesses the requisite skill <br />and knowledge to conduct a reasonable compliance review of the Verification Documents. May include, <br />without limitation, an immigration compliance attorney or law firm, a human resources compliance firm, <br />or a similar professional services firm engaged in providing administrative or consulting services related <br />to immigration compliance.
