<br />Payment shall be due as set forth below, and in the event of non-payment, should legal <br />action be necessary for Contractor to collect just payment due, any attorney and court <br />costs incurred shall be paid by the undersigned Owner. <br /> <br />CONTRACT PRICE IS Thirty-Five Thousand Dollars ($35,000.00) $3,500 deposit, <br />draws based on percentage of completion during construction and balance immediately <br />upon completion and final inspection by the governing authority. <br /> <br />Extra work or materials desired by the Owner shall be agreed upon in writing and shall <br />form the basis of the change order which shall be executed between the parties and <br />thereby become a part of this contract. Unless otherwise agreed upon, such extra work <br />shall be paid for as such work is performed. Requests for changes should be submitted <br />to Contractor on "Change Order Request" forms as provided by builder, completed by <br />Owner's Agent. <br /> <br />Notwithstanding anything set forth in the Contract to the contrary, if the Owner has <br />orally authorized the work, the Contractor has performed the work and the Owner's <br />Agent has accepted this extra work or materials without the execution of a written <br />change order, the Contractor shall nonetheless be entitled to payment therefore. It is <br />further presume that the Owner has accepted such extra work in the absence of a written <br />notice to the contrary.
