<br />the City at the expense of the property owner, including any <br />sodding that may be necessary. <br /> <br />F. Each fence or wall erected pursuant to this section <br />shall be of uniform construction and properly maintained and in <br />no case shall a fence or wall either be erect~d or maintained in <br />such a manner as to degrade neighborhood amenities or reduce <br />surrounding property values, or maintained in such a state of <br />disrepair so as to pose a hazard to the community. <br />4332.' Use and Location of Buffers <br /> <br />A. Areas set aside as required buffers may also: <br /> <br />1. be used to satisfy minimum setback requirement. I <br /> <br />2. be used to satisfy minimum open space requirement., <br /> <br />3. contain stormwater retention or detention area., so <br />long as the required buffer plantings are provided and the design <br />and landscaping of the buffer do not interfere with the proper <br />functioning of the drainage system, the design water depth does <br />not harm the viability of. the plantings; , <br /> <br />4. be used for passive recreation such as pedestrian, <br />bicycle or equestrian trails, subject to ,the following <br />limitations: <br /> <br />a. no plant material is eliminated, <br />b. the total width of the buffer is maintained I <br /> <br />c. all other requirements of tne Code are met~ <br /> <br />'.,5. be used for the installation of underground <br />utili ties ,:~:~so .'long as the loca tio.n and use of the utility lines <br />do not interfere with the required buffer plantings. <br /> <br />B. The fOllowing uses shall not be allowed in a required <br />buffer: playfields, stables, swimming pOOls, tennis courts or <br />similar active recreation uses, storage facilities, or parking <br />facilities. <br /> <br />C. General Location and Design Requirements <br /> <br />1. Buffers shall be located on the outer perimeter of <br />a lot or parcel, extending to the lot or parcel boundary line. <br /> <br />2. Buffers shall not be located on any portion of an <br />eXisting, dedicated, or proposed right-of-way, or private street. <br /> <br />3. Where an existing easement is partially or wholly <br />within a required buffer, the develope~ shall design the buffer <br />to eliminate ~r minimize plantings within the easement. <br /> <br />4. Where a proposed development is.a mixed use <br />project, buffers shall not be required between various <br />constituent parts, except that any nonresidential use shall be <br />separate from residential use by a minimum required buffer. <br />(Note: It is the intent of this section to allow flexibility of <br />design within the confines of a mixed use development, but to <br />nevertheless require the bUffering of a proposed residential <br />portion of the project from the potential negative impact of a <br />proposed nonresidential portion of the project.) <br />
