<br />BOARD :OF ADJUSTMENT <br /> <br />The Board of Adjustment meeting was held on Tuesday, August 10, <br />2004, at 4:00 p.m. in the City Council Chambers of City Hall. <br />Present were members Wallace Reeves, Nell Petty and Gary Hatrick. <br />Also present were Bill Burgess, Building Official and Karla Owens, <br />City attorney. Absent were Pat Besinger and William Poe, Sr. <br /> <br />Meeting was called to order by Chairman Reeves. Roll call was <br />taken, followed by the Pledge of Allegiance. <br /> <br />Approval/correction of minutes - July 13, 2004. Motion was made by <br />Gary Hatrick to approve the minutes. Seconded by Nell Petty and <br />passed unanimously. <br /> <br />Item 1 - Patrick A. Biddle, 39049 Cardinal Avenue. Variance <br />request to allow setbacks of 3 foot on the rear and 3.75 foot on <br />the side for proposed shed. <br /> <br />Mr. Biddle, homeowner, presented his side, stating he did not know <br />a building permit was required and that he had a 10'x14' concrete <br />slab poured with two course of blocks laid where previous owners <br />had had a shed. It was at this point that Burgess issued a stop <br />work order on his site for non-compliance of a required permit. <br /> <br />Mr. Biddle proceeded to the Building Department for a permit, but <br />since his site plan did not meet required setbacks for the shed, he <br />was informed that he would need to apply for a variance. <br /> <br />After lengthy discussion, it seemed to be questionable as to <br />whether Mr. Biddle's situation constituted a hardship. Therefore, <br />motion was made by Gary Hatrick to have a continuance of this <br />request until Tuesday, September 14th, allowing board members to do <br />an on-site inspection of the property. Seconded by Nell Petty and <br />passed unanimously. Board members agreed to meet for the on-site <br />inspection on Friday, August 20th at 10 a.m. Attorney Owens <br />cautioned members to not discuss continuation of said meeting with <br />the owner. <br /> <br />Item 2 - Petroleum Plus, Inc., 5855 Gall Boulevard. Variance <br />request for front building setback of 16 feet to proposed gas <br />island canopy column. <br />
