REGULAR COUNCIL MEETING <br /> A Regular Council Meeting was held on March 23, 2009 at 6:00 p.m. in the Robert H. <br /> Johnson Council Chambers of the Municipal Building. <br /> President Lopez called the meeting to order. Roll call was taken. Present were members <br /> Clyde Bracknell, Kenneth Compton, Manny Funes, Luis Lopez, Jodi Wilkeson and Mayor Cliff <br /> McDuffie. City Manager Steve Spina and City Attorney Joseph Poblick were also present. <br /> Staff present: Police Lieutenant Derek Brewer, Fire Chief Keith Williams, Utilities <br /> Superintendent David Henderson, Public Works Director Rick Moore, Building Official Bill <br /> Burgess, Director of Development Todd Vande Berg, Airport Manager Trina Sweet and City <br /> Clerk Linda Boan. <br /> Mayor Cliff McDuffie gave the Invocation. The Pledge of Allegiance followed. Clyde <br /> Bracknell moved the minutes of the March 9, 2009 Regular Meeting be approved. Seconded by <br /> Manny Funes. Motion passed unanimously. <br /> MAYOR <br /> 1. Proclamation — National Kite Month <br /> Mayor McDuffie read a proclamation in which he proclaimed April 2009 Kite Month in <br /> the City of Zephyrhills. He presented the proclamation to the staff of Goin' Postal. <br /> 2. Proclamation — Water Conservation Month <br /> Mayor McDuffie read a proclamation in which he proclaimed the month of April 2009 as <br /> Water Conservation Month and called upon each citizen and business to practice water saving <br /> measures. He presented the proclamation to employees of the utility department, Superintendent <br /> David Henderson, water supervisor Nathan Coleman, and water foreman Bruce Sellars. <br /> 3. CR54 Alignment Presentation <br /> Marty Marlon representative from American Consulting Engineering and Andy Alipour <br /> project manager from Pasco County provided an update on the County Road 54 Route and Pond <br /> Study from US 301 to 23 Street that will be submitted to the Board of County Commissioners. <br /> Their preferred alignment will be recommended consisted of building alternative 1 — South <br /> Alignment — with additional required right -of -way predominantly on the south side which will <br /> require 6 parcels totaling 2.93 acres. The long range project will be jointly funded and will meet <br /> the existing needs and for future 2030 traffic. This was for information only. <br /> 4. Krusen Field Appeal <br /> Director of ZPAL Mark LaMonte addressed Council regarding his bid proposal for the <br /> use of Krusen Field. The Site Plan Review Committee had ranked the two proposals and the <br /> outcome was a 1 point difference with ZPAL prevailing. However because of a question <br /> regarding the validity of insurance Mr. Spina awarded the use of Krusen Field to ZPPAL. ZPAL <br /> requested the appeal to City Council. <br /> The following persons spoke from the floor: Marsha Desena, 8203 Cindy Drive, Cory <br /> Swanstrom, 3025 Coats Road, Horace West, 547 Sierra Circle, Haines City, FL, and Deann <br /> Ainsworth, 5310 King Street. <br /> Kenneth Compton said it was his understanding that ZPAL received the most points in <br /> the ranking and the reason for the question today is the insurance. He then moved the bidding be <br /> awarded to ZPAL since they received the most points with the condition of staff's satisfaction <br /> that they are covered insurance and the City of Zephyrhills is named as additional insured. <br /> Seconded by Clyde Bracknell. Motion failed 2 -3 with Jodi Wilkeson, Luis Lopez and Manny <br /> Funes voting against the motion. <br /> Kenneth Compton moved ZPAL be approved as the bid recipient on two conditions. 1) <br /> Staff is satisfied the adequate insurance is provided to cover the City and 2) ZPAL will do new <br /> background checks, and provide evidence, through the Zephyrhills Police Department that are <br /> local, state and national at the expense of ZPAL. Seconded by Clyde Bracknell. Motion passed <br /> 3 -2 with Luis Lopez and Manny Funes voting against the motion. <br />
