We have <br /> a signed and recorded Developers Agreement with the City of Zephyr Hills that identifies sit -down restaurants as an <br /> approved and included use covered by the set impact fees. The DA is not in default and we have lived up to our <br /> obligations. We have signed leases that are being delayed. <br /> We are all well aware that the Developers Agreement was intended to set the impact fees for this phase of the project in <br /> exchange for the ROW and road improvements for the City rather than impact fee credits. The Developers Agreement <br /> can not be amended unilaterally.
