We are still working with SWFWMD on the pond conversion issue. I will keep you posted there. <br /> 2. We have run into a little problem on our impact fees on Zephyr Commons. One of our tenants (a Chinese <br /> restaurant) came in to get permits for its improvements and was quoted a rate which is inconsistent with the <br /> Development Agreement. The DA states, "Impact Fees due from the Developer during the term of this <br /> Agreement shall be $5,746 per thousand square feet all retail uses in the entire shopping center including out <br /> parcels." Apparently, the new quoted rates were substantially higher. Can you get this sorted out for us? As you <br /> know, the DA set the rates for the entire development based on the fact that we undertook certain off -site <br /> improvements for the benefit of the City and County which could have been impact fee creditable, but for which <br /> we elected not to seek impact fee credits.
