4: Contractor's Duties <br /> Before proceeding with the Contract Work, Contractor shall check the correctness of contiguous work <br /> installed by others and the failure to detect or report discrepancies will preclude the Contractor from <br /> recovery of any resulting cost, expense or damage. <br /> The Contractor shall keep the building and premises clean of debris resulting from the performance of <br /> its work. <br /> Contractor shall give adequate notices pertaining to its work to the proper authorities and shall be <br /> secure and pay for all necessary licenses, permits, tap and use fees to carry on the Work. Contractor <br /> shall promptly furnish, shop drawings, manufacturer's data, templates, schedules, reports or any other <br /> data that may be necessary for proper prosecution of the Work including distribution among other <br /> contractors. Contractor shall lay out his own work and be responsible for the accuracy of same. <br /> Contractor shall exercise the utmost diligence in obtaining all drawings, details and information <br /> necessary to perform its work. Contractor shall, before proceeding with any affected part of the work, <br /> call to Owner's attention in writing any errors or inconsistencies in the Contract Documents. Contractor <br /> shall coordinate its Work with Owner, all other contractors, subcontractors and suppliers on the Project <br /> so as not to delay or damage their performance, work or the Project. <br /> 5. Payment <br /> Contractor shall submit Monthly invoices to Owner. Owner shall make payment for 90% of the amount <br /> of labor and materials delivered and installed in the Project, less any previous payments. Each <br /> payment, including the final payment, is subject to receipt of proof acceptable to Owner that all <br /> subcontractors and material men have been paid and that no liens can attach to the property. <br /> Payment to the Contractor does not constitute or imply acceptance by the Owner of any portion of the <br /> Contractor's Work. The Owner shall make final payment within ten (10) days after satisfactory <br /> completion and final acceptance of the Work by the Owner. <br /> 6. Changes <br /> Contractor may be directed in writing to make changes in Contractor's Work. Claims for extra or <br /> changed work will be allowed only upon prior written authorization signed by Owner's Representative. <br /> Changes will be made on an agreed upon lump sum or based upon daily work sheets showing the cost <br /> of materials, labor rates and the hours worked, all as approved in writing by Owner's Representative. <br /> 7. Overtime <br /> The Owner shall have the right to order Contractor to work overtime in order to expedite the final <br /> completion of the Work and it is agreed that for such overtime, the Owner shall pay only the premium <br /> time cost of the labor plus liability insurance any payroll taxes thereon. Should it be necessary, in the <br /> Owner's opinion, for the Contractor to work overtime due to the failure on the Contractor's part to <br /> maintain the schedule or keep up with the general progress of the work, then the Contractor shall work <br /> overtime and the entire cost and expense so incurred shall be borne by the Contractor. <br /> 8. Damage to Work <br /> Contractor shall at all times and at its expense protect the Work and all labor, materials, supplies, tools <br /> and equipment against any damage, injury, destruction, theft or loss for all of which Contractor shall be <br /> solely responsible and in no event shall Owner be liable or responsible therefore. Contractor shall at <br /> its expense promptly repair or replace damage to work of others, or to the Project, resulting from its <br /> activities. <br /> 2 <br />
