9. Insurance <br /> Prior to starting work, Contractor, at its expense, shall obtain and maintain ip.force, on all operations, <br /> insurance in accordance with requirements listed below. The policies of insurance shall be in such <br /> form and shall be issued by such company as may be satisfactory to Owner. Certificate of Insurance <br /> shall be filed with Owner prior to commencement of the Work. <br /> The insurance required shall be written for not less than the following limits, or greater if required by <br /> law. <br /> 1. Worker's Compensation: <br /> a. Applicable State Statutory Limit <br /> b. Employer's Liability: $1,000,000 per Accident <br /> 2. Comprehensive or Commercial General Liability (Including Premises - Operations; Independent <br /> Vendor's Protective; Products and Completed Operation; Broad Form Property Damage): <br /> a: Bodily Injury and Property Damage: <br /> $1,000,000 Combined Single Limit (CSL) Each Occurrence <br /> Minimum $2,000,000 Aggregate or Per Project Endorsement <br /> 3. Contractual Liability: <br /> Same coverage as 2.a. above <br /> 4. Business Auto Liability (including owned, no -owned and hired vehicles): <br /> a: Bodily Injury and Property Damage: <br /> Minimum $2,000,000 Aggregate or Per Project Endorsement <br /> 10. Indemnity <br /> To the fullest extent permitted by law, Contractor shall indemnify and hold harmless Owner. Owner's <br /> parent Corporation SUPERVALU Inc. and its subsidiaries, Architect if any, and their agents and <br /> employees from any and all claims, damages, losses or expenses, including attorney's fees, caused in <br /> whole or in part by any act or omission of Contractor or any of its agents, employees or subcontractors. <br /> 11. Compliance with Law and Safety <br /> All work to be furnished by Contractor must strictly comply with all applicable federal, state and local <br /> laws, regulations, statutes, ordinances and directives (hereinafter "Laws ") now in force or hereafter in <br /> effect. Contractor agrees to indemnify and save Owner harmless from and against any and all claims, <br /> loss or expense caused directly or indirectly by its failure to fully comply with such Laws. Contractor <br /> agrees that the prevention of accidents to workers engaged)in Contract Work is solely its responsibility. <br /> Contractor shall comply with all applicable safety laws and to any safety standards established during <br /> the progress of the work. <br /> 12. Warranties <br /> The Contractor represents and warrants that all goods furnished pursuant to this Agreement are free <br /> from encumbrance, free from defect and are merchantable quality and new unless otherwise required <br /> or permitted in the Contract Documents. The Contractor further represents and warrants that all Work <br /> is in accordance with the requirements of the Contract Documents. If within one (1) year after the date <br /> of Substantial Completion of the Work, any Work is found not to be in accordance with the Contract <br /> Documents, it shall be corrected promptly by the Contractor after receipt of written notice from the <br /> Owner. This shall not limit any other rights or remedies of the Owner for Contractor's breach. <br />
