10.) Miscellaneous: <br /> a.) Conditional use petition will be advertised/posted; <br /> b.)Notifications to abutting property owners will be sent; <br /> c.) $150.00 petition fee submitted. • <br /> 11.) Recommendation: The Planning Deparhnent staff recommends approval of the conditional use <br /> petition for an accessory structure at 5738 Cypress Street with the following conditions: <br /> a.) The holder of a conditional use permit shall be authorized to utilize the site or location of the use <br /> only in the manner specified in the written approval and conditions specified therein. Any <br /> substantial expansion, alteration or change in the conditional use authorized by the written approval <br /> must be reviewed by the City Council in the same manner in which the original conditional use was <br /> reviewed; <br /> b.)For purpose of this section, an expansion, alteration or change of a conditional use shall be <br /> deemed to exist where a substantial modification of any of the standards provided for in condition <br /> 11 (a) above, results from activity associated with the conditional use or where a substantial change <br /> of circumstances or conditions arises; <br /> c.) The conditions and stipulations shall become part of the written approval and must be conformed <br /> to or followed by the applicant or any successor in interest; and <br /> d.) The conditional use approval shall run with the current ownership and lessee. All future issues <br /> related to the subject use and identified by City Staff shall be presented to and satisfactorily <br /> addressed by the Owner/lessee; <br /> e.) The proposed structure shall comply with rendering submitted and roof height not to exceed the <br /> height of the primary residence. <br /> SPRC Recommendation: Approval with above special approval conditions <br /> Planning Commission Recommendation: <br />
