95.10 Trade Names are used in the basic specification to estabfish quality and type of <br /> material required; exact material to be used on a specific property will be described in <br /> the "Work Write-Up"for the particular property. <br /> 15.11 AdiacQnt Propertv- When adjacent property is affected or endangered by any work <br /> done under this contract, it shali be the responsibility of the Contractor to take <br /> whatever steps are necessary for the protection of the adjacent property and to notify <br /> the Owner thereof of such hazards. <br /> 15.12 Pavroil Records of empioyes's hours worked and wages paid on construcfion jobs <br /> sha(I be made available to the Community Developrnent Division, if requested. <br /> � 15.13 The Use of Lead-Based Paint on applicabie surfaces of any residential s#ructure <br /> undergoing Federally assisted construction or construction under any program with <br /> federal assistance is prohibited. Any surface which contains lead-based paint shatl be <br /> considered an immediate health hazartf. <br /> 15.14 The recognized amount of the contract is the Proposal page of the Bid, which is signed <br /> by the Contractor. The prices that a�e detailed in the work write-up are for information <br /> only. <br /> ARTICLE 16. - ARBITRATION: The Contractor and Owner agree, that in cases of apparent <br /> irreconcilable differences arising in connection with contract performance or terms of the contract during the <br /> progress of the construction, to submit the matter #o the Community Development Division for binding <br /> arbitration. <br /> ARTICLE 17. - LIEN WAIVERS: Contractor agrees to protect, defend, and indemnify the Community <br /> Development Division and the Owner from any claims for unpaid work, labor, or materials with respect to <br /> Cantracfor's performance. Final payment shal! not be due unti! the Contractor has delivered to the Owner, in <br /> care of Community Development Division, complete release of all (iens for work completed arising out of <br /> Cantracfor's performance or a receipt in full covering all (abor and materia(s for which a lien could be filed or a <br /> bond satisfactory to the Owner indemnifying him against any lien. All nottce to owners must have a release af <br /> lien far�nai payment.
