ARTICLE 99. - INTEREST OF MEMBERS. OFFICERS. EMPLQYEES OF PUBLIC BQDY MEMBERS <br /> OF LOCAL GOVERNlNG BODY, OR OTHER PUBLIC OFFICIALS: No member, office�, or employee of <br /> Pasco County, or i#s designees or agents, no member af the goveming body of the locality in which the <br /> program is situated, and na ofher public official of such loca[ity or localities who exercises any functians or <br /> responsibilities with respect to the program during his tenure or for one (1) year thereafter, shall have any <br /> interest, direct or indirec#, in any contracf or subcontracf, or the proceeds thereof, fo�work to be performed in <br /> connection with the program assisted under the Contract. <br /> ARTICLE 28. - PROHIBiTION OF BONUS OR COMMISSION: The assistance provided under this <br /> Contract shall not be used in payment of any bonus or commission for the purpose of ob#aining County <br /> approval of the app(ication for such assistance. <br /> ARTICLE 24. - LOCAL EMPLOYMENT: To the greatest exfent possible, the Contractor agrees to hire, <br /> train, and subcontract to individuals and firms that live or are located in Pasco County and the Tampa Bay <br /> Area. <br /> ARTiCLE 22. - MINORITY AND WOMEN BUSINESS ENTERPRISE: To the greatest extent possible, <br /> the Contractor agrees that he wili, if i# is necessary, subcontrac# wo�lc to minority- and women-owned <br /> businesses. <br /> ARTICLE 23. — SECTION 3: HUD ACT OF 19G8: The Section 3 preference requirement applies to <br /> any contract in excess of $100,000.00. The purpose of Section 3 is to ensure that employment opportunities <br /> gene�ated by HUD financial assistance, shal! to the greatest extent feasible, be directed to low- and very low- <br /> income persons, particularly those who are recipisnts of govemment assistance for housing and to business <br /> concerns that provide econornic opportunities to low- and very low-income persons. If this contract is in <br /> excess of$100,000.00 the following language is applicable, and shall be included in any subcontracts: <br /> Sectian 3 Ciause: Al! section 3 contracts shal( include the following clause (referred to as the Section 3 <br /> . Clause): <br /> 23.1 The work to be pertormed under fhis contract is subject to the requirements of Section 3 of the <br /> Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701u. Secfion 3 <br /> requires that, to the greatest extent feasible, opportunities for training and employmen# be given <br /> lower-income resiclents of the project area, and contracts for work in connection with the project <br /> be awarded to business concems, which are located in or owned in substantial part by persons <br /> residing in the area of the projec#. <br /> 23.2 The parties to this contract agree to camply with HUD's regulations in 24 Part CFR 135, and alI <br /> applicable rules and orders of the Department issued thereunder prior to the execution of this <br /> contract. As evidenced by fheir execution of this contract, the parties to this contract certify that <br /> they are under no contractual or other impediment, which would prevent them from complying <br /> with the Pa►# 135 regulations. <br /> 23.3 The contractor agrees to send #o each labor organization o� representative of worke�s with <br /> which the contractor has a collective bargaining agreement or other contract ar understanding, if <br /> any, a notice advising the labor organization or workers' representative of #he contractor's <br /> commitments under this Section 3 Clause and shall post copies of the notics in conspicuous <br /> places at the work site where both employees and applicants for training and employment <br /> positions can see the notice. The notice shall describe the Section 3 preference, shall set forth <br /> minimum number and job titles subject to hire, availability of apprenticeship and training <br /> positions, the qualifications for each; and the name and locatfon of the person{s� taking <br /> applications for each ofi the positions; and the anticipated date the work shall begin. <br /> 23.4 The contractor agrees to include this Section 3 Cfause in every subcontract for work in <br /> connection with the project and agrees to take appropriate action, as provided in an applicable <br /> S/Community Development/Mousing Fortns Revised 04127111 <br /> -7- <br />
