15.10 Trade Names are used in the basic specificatiort to establish quality and type of <br /> material required; exact material to be used on a specific property will be described in <br /> the"Work Write-Up"for the particutar property. <br /> 15.11 Adiacent Propertv- When adjacent property is affected or endangered by any work <br /> done under this contract, i# shall be the responsibility af the Contractor to take <br /> whatever steps are necessary for the protection of the adjacerrt property and to notify <br /> #he Owner thereof of such hazards. <br /> 15.12 Pavroll Records of empioyee's hours worked and wages paid on construction jobs <br /> shall be rnade available to the Community Development Division, if requested. <br /> 95.13 The Use of Lead-Based Painf on applicable surfaces of any residential sfructure <br /> undergoing F'ederally assisted construction or cons#ruction under any program with <br /> federal assistance is prohibited. Any surtace which contains lead-based paint shall be <br /> . considered an immediate heafth hazard. <br /> 15.14 The recognized amount of the contract is the Proposal page of the Bid, which is signed <br /> by the Contractor. The prices that are detai[ed in the work write-up are for information <br /> only. <br /> ARTlCLE 16. - ARBITRATION: The Contractor and Owner agree, that in cases of apparent <br /> irreconcilable differences arising in connection with contract performance or terms of fhe contract during the <br /> progress of the construc#ian, to submit the maf�er to the Community Development Division for binding <br /> arbitration. <br /> ARTICLE 17. - UEN WAIVERS: Contractor agrees to protect, defend, and indemnify the Community <br /> Develapment Division and the 4wner from any claims for unpaid work, labor, or materials with respect to <br /> Contractar's performance. Final payment shalf not be due until the Contractor has delivered to the Owner, in <br /> care of Community Developmertt Division, complete release of all liens for work completed arising ouf of <br /> Contractor's performance or a receipt in fulf covering all labor and materials for which a lien could be filed or a <br /> bond satisfactory to the Owner indemnifying him against any lien. All notice to owners must have a relsase of <br /> lien for final payment. (Form Enclosed in Contract). <br /> ARTICLE 18. - PROHIBITION OF KICKBACKS: The Contractor nor any of its officers, partners, <br /> owners, agents, representatives, employees, or parties in interest has in any way colluded, conspired, <br /> connived, or agreed, directly or indirectly with any other Bidder, firm, or person to submit a colfusive or shall <br /> Bid in connection with the Contractor for which the attached Bid has been submitted or to refirain from bidding <br /> in connection with such contract, or has in any manner, directly or indirectly, sought by contrac#or collusion or <br /> cflmmunication ar conference with any other Bidder, firm, or person to fix any overhead, profd, or cost element <br /> of the Bid price or the Bid price of any other Bidder, or to secure through any collusion, conspiracy, <br /> connivance, or uniawful contract, any advantage against the Pasco County Community Development Divisian, <br /> or any person interested in the proposed contract; and, <br /> The price or prices quotec! are fair and proper and are not tainted by any collusion, conspiracy, <br /> connivance, or unlawful contracf on the part of the Bidder or any of its agents, representatives, ov+mers, <br /> empfoyees, or parties in interest, including this affant. <br /> S/Communify DevelopmentlHousing Forms Revised 04/27/11 <br /> - 6 - <br />
