ARTtCLE 49. - INTEREST OF MEMBERS. OFFICERS. EMPLOYEES OF PUBLIC BODY MEMBERS <br /> OF LOCA� GOVERNING BODY. OR OTHER PUBL.IC OFFICIALS: No membe�, officer, or empiayee of <br /> Pasco Courrty, or its designees or agents, no member of the goveming body of the locafity in which the <br /> program is situated, and no other public official of such locality o� focalifies who exercises any functions or <br /> responsibilities with respect to the program during his tenure or for one (1) year thereafter, shall have any <br /> interest, direct or indirect, in any contract or subcontract, or the proceeds thereof, for work to be performed in <br /> connection with the program assisted under the Contract. <br /> ARTICLE 20. - PROH16lTiON OF BONUS OR COMMISSION: The assistance provided under this <br /> Contract shall not be used in payment of any bonus or commission for the purpose of obtaining County <br /> approval of the application for such assistance. <br /> ARTICLE 21. - LOCAL EMPLOYMENT: To the greatest extent possible, the Contractor agrees to hire, <br /> train, and subcontract to individuals and firms that live or are located in Pasco County and the Tampa Bay <br /> Area. <br /> ARTlCLE 22. - MINORITY AND WOMEN BUSINESS ENTERPRtSE: To the greatest extent possible, <br /> the Contractor agrees that he will, if it is necessary, subcontract work to minority- and women-owned <br /> businesses. <br /> ARTICLE 23. — SECTION 3: HUD ACT OF 1968: The Section 3 preference requirement applies to <br /> any contract in excess of$100,000.00. The purpose of Section 3 is to ensure that employment opportuni#ies <br /> generated by HUD financial assistance, shall to the greatesf extent feasEble, be directed to low- and �ery low- <br /> income persons, particularly those who are recipients of govemment assistance for housing and to business <br /> concerns that provide economic opportunities to low- and very low-income persons. If this contract is in <br /> excess of$100,000.00 the fol(owing language is applicable, and shall be included in any subcontracts: <br /> Section 3 Clause: All section 3 contracts shall include the following clause (referred to as the Sectio� 3 <br /> Clause}: <br /> 23.1 The work to be performed under this contract is subject to the requirements of Section 3 of the <br /> Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701u. Section 3 <br /> requires that, to the greatest extent feasible, opportunities for training and emplayment be given <br /> lower-income residents of the project area, and contracts for work in connection with the project <br /> f�e awarded to business concerns, which are located in o�owned in substantial part by persons <br /> residing in the area of the project. <br /> 23.2 The parties ta this contract agree to comply with HUD's regufations in 24 Part CFR 135, and all <br /> applicable rules and orders of the Department issued thereunder prior fo the execution of this <br /> contract. As evidenced by their execution of this contract, the parties to this contract certify that <br /> they are under no contractual or other impediment, which wou(d prevent them from complying <br /> with the Part '!35 regulations. <br /> 23.3 The contractor agrees to send to each Iabor organization or representative of workers with <br /> which the contractor has a colleetive bargaining agreement or other contract or understanding, if <br /> any, a notice advising the fabor organization or workers' representative of the contractor's <br /> commitments under this Section 3 Clause and shall post copies of the notice in conspicuous <br /> places at the work site where both employees and applicants for training and employment <br /> positions can see the notice. The notice shalf describe the Section 3 preference, shail set forth <br /> minimum number and job #itles subject to hi�e, avai[ability of apprenticeship and trai�ing <br /> positions, the qualifications for each; and the name and location of the person(s) taking <br /> applications for each of the positions; and the anticipated date the wo�ic shall begin. <br /> 23.4 The contractar agrees to inciude this Section 3 Clause in every subcontract for work in <br /> connection with the project and agrees to take app�opriate action, as provided in an applicable <br /> S/Community DevelopmenUHousing Forms Revised 04/27/11 <br /> - 7 - <br />
