15.10 Trade Names are used in the basic specification to estabiish quality and type of <br /> material required; exact material to be used on a specific property will be described in <br /> the "Work Write-Up"for the particular property. <br /> 15.11 Adiacent Pronert,�- When adjacent property is affected or endangered by any work <br /> done under thfs cont�act, it shall be the responsibiliry of the Contractor #o #ake <br /> whatever steps are necessary for the protection of the adjacen# property and to notify <br /> the Owner thereof of such hazards. <br /> 15.12 Payroll Records o# employee's hours worked and wages paid on constru�tion jobs <br /> shall be made avaiiabie to the Community Development Division, if requestsd. <br /> 95.93 The Use of Lead-Based Paint on applicable surtaces af any residential struc#ure <br /> undergoing Federally assis#ed construction or construction under any program with <br /> federal assistance is prohibited. Any surtace which contains lead-based paint shall be <br /> considered an immediate health hazard. <br /> 15.14 The recognized amount of the contract is the Proposal page of the Bid, which is signed <br /> by the Contractor. The prices that are detailed in the work write-up are for information <br /> only. <br /> ARTICLE 16. - ARBITRATION: The Contractor and Owner agree, that in cases of apparent <br /> irreconcilable differences arising in connection with contract pertarmance or terms of the contract during the <br /> progress of the cons#ruction, to submit the mafter to the Community Development Division for binding <br /> arbitration. <br /> ARTICLE 97. - LtEN WAIVERS: Contractor ag�ees to protect, defend, and indemnify the Community <br /> Development Division and the Owner from any claims for unpaid work, labor, ot materials with respect to <br /> Contractor's performance. Final payment shall not be due unti[ the Contractor has delivered fo the Owner, in <br /> care of Community Development Division, complete release of all liens for work completed arising out of <br /> Contractor's pertormance ar a �eceipt in full covering al! labar and materials for which a lien could be filed or a <br /> bond satisfactory to the Owner indemnifying him against any lien. All notice to owners must have a release of <br /> lien for final payment. �Form Enclosed in Contract). <br /> ARTICLE 18. - PROHIBITION OF KICKBACKS: The Contractor nor any of its officers, partners, <br /> owners, agents, representatives, employees, or parties in interest has in any way colluded, conspired, <br /> connived, or agreed, directly or indirectly with any o#her Bidder, firm, or person to submit a collusive or shall <br /> Bid in connection with the Contractor for which fhe attached Bid has been submitted or to refrain from bidding <br /> in connection with such contract, or has in any rnanner, directly or indirectly, sought by contract or collusion or <br /> communication or conference wi#h any other Bidder, firm, or person to fix any overhead, profit, or cost element <br /> of the Bid price or the Bid price of any other Bidder, or to secure through any collusion, conspiracy, <br /> connivance, or unlawful contract, any advantage against the Pasco County Community Development Division, <br /> or any pe�son interested in the proposed confract; and, <br /> The price or prices quoted are fair and proper and are nof fainted by any collusion, canspiracy, <br /> connivance, or unlawful contract on the part of the Bidder or any of its agents, representatives, owners, <br /> empfoyees, or parties in interest, including t�is affiant_ <br /> S/Community Development/Housing Forms Revised 04/271i 1 <br /> -6 - <br />
