ARTICLE 19. - INTEREST OF MEMBERS FFICERS EMPLOYEES OF PUBLIC BODY MEMBERS <br /> OF LOCAL GOVERNING BODY. OR OTHER PUBLtC OFFICIALS: No member, officer, or employee of <br /> Pasco County, or its designees or agents, no member of the governing E�ody of the locality in which the <br /> pragram is situated, and no other public official of such locality or localities who exercises any functions or <br /> responsibilities with respec#to the program during his tenure or far one (1) year thereafter, shall have any <br /> interest, direct or indirect, In any con#ract or subcontract, or the proceeds thereof, for work to be performed in <br /> connection with the program assisted under the Contract. <br /> ARTICLE 20. - PROHIBITION OF BONUS OR COMMtSSION: The assistance provided under this <br /> Contract shaf( not be used in payment of any bonus or commission for the purpose of ob#aining County <br /> approval of the application for such assistance. <br /> ARTICLE 21. -L.00AL EMPLOYMENT: To the greatest extent possible, the Contractor agrees to hi�e, <br /> train, and subcontract to individuals and firms that live or are located in Pasca County and the Tampa Bay <br /> Area. <br /> ARTICLE 22. - MlNORITY AND WOMEN BUSINESS ENTERPRISE: To the greatest extent passible, <br /> the Contractor agrees that he will, if it is necessary, subcontract work to minority- and women-owned <br /> businesses. <br /> ARTICLE 23. — SECTION 3: HUD ACT OF 1968: The Section 3 preference requirement applies to <br /> any contract in excess of $'[00,000.00. The purpose of Section 3 is to ensure that employment opportunities <br /> generated by HUD financial assistance, shal!to the greatest extent feasible, be directed to low- and very low- <br /> income persons, particula�ly those who are recipients of govemment assistance for housing and to business <br /> concems that provide economic opportunities to low- and very low-income pe�sons. If this contracf is in <br /> excess of$100,000.00 the following language is applicable, and shall be included in any subcontracts: <br /> Sec#ion 3 Clause: All section 3 contracts shall include the following clause (referred to as the Section 3 <br /> Clause): <br /> 23.1 The wark to be performed under this contract is subject to the requirements of Section 3 of the <br /> Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701u. Section 3 <br /> requires that, to fhe greatest extent feasible, opportunities for tra'tning and employment be given <br /> fower-income residents of the project area, and contrac#s for work in connection with the project <br /> be awarded to business concerns, which are located in or owned in substantiat part by persons <br /> residing in the area of the project. <br /> 23.2 The parties #o this contract agree to comply with HUD's �egulations in 24 Part CFR 135, and all <br /> applicable rules and orders of the Department issued thereunder prior to the execution of this <br /> contract. As evidenced by their execution of this contract, the parties to this contract certify that <br /> they are under no contractual or other impediment, which would prevent them from complying <br /> with the Part 135 regulations. <br /> 23.3 The contractor agrees to send to each labor organization or representative of workers wifh <br /> which the contractor has a collective bargaining agreement or other cantract or u�derstanding, if <br /> any, a notice advising the labor organization or warkers' representative of the contractor's <br /> commitments under this Section 3 Clause and shall post copies of the notice in conspicuous <br /> places at the work site where both employees and applicants for training and employment <br /> positions can see the notice. The notice shall describe the Section 3 preference, shall set forth <br /> minimum number and job titles subject to hire, availability of apprenticeship and training <br /> positions, the qualifications for each; and the name and iocation of the person(s) taking <br /> applications for each of the positions; and the anticipated date the work shall begin. <br /> 23_4 The contractor agrees to include this Sectiort 3 Clause in every subcontract for work in <br /> connection with the project and agrees to take appropriate action, as provided in an applicable <br /> S/Community Development/Housing Forms Revised 04l27/11 <br /> -7- <br />
