15.10 Trade Names are used in the basic specification to establfsh quality and type of <br /> material required; exact material to be used on a speciffc property wi!( be described in <br /> the "Work Write-Up"for#he parEicular property. <br /> 15.11 Adiacent Prot�ert_v- When adjacent property is affected ar endangered by any wark <br /> done under this contract, it shall be the responsibility vf the Cantra�tor to take <br /> whatever steps are necessary for fhe protection of the adjacent property and to notify <br /> the Owner thereof of such hazards. <br /> 15.12 Pa roll Records of employee's hours worked and wages paid on construction jabs <br /> shall be made available to the Community Development Division, if requested. <br /> 15.13 The Use of Lead-Based Paint on appiicable surtaces of any residential structure <br /> undergoing Federally assis#ed constntction or construction under any program with <br /> federal assistance is prohibited. Any surface which contains iead-based paint shall be <br /> considered an immediate health hazard. <br /> 15.14 The recognized amount of the contrac# is the Proposal page af the Bid, which is signed <br /> by the Contractor. The prices that are detailed in the work write-up are for infarmation <br /> only. <br /> ARTICLE 16. - ARBITRATIQN: The Contractor and Owner agree, that in cases of apparent <br /> irreconciiable differences arising in connection with contract performance or terms of the contract during the <br /> progress of the construction, to submit the matter to the Community Development Division far binding <br /> arbitration. <br /> ARTICLE 17. - LIEN WAIVERS: Contractor agrees to protec#, defend, and indemnify the Community <br /> Development Division and the Owner from any claims far unpaid work, fabor, or materials with respect to <br /> Contractor's pertormance. Final payment shall no# be due until the Contractor has delivered to the Owner, in <br /> care of Community Development Division, complete release of aIl lisns for work completed a�ising out of <br /> Contractor's performance or a receipt in full cove�ing all labor and materials for which a lien could be filed or a <br /> band satisfactory to the Owner indemnifying him against any lien. All notice to owners must have a release of <br /> (ien for final payment.
