ARTICLE 13. - TERMINATION OF CONTRACT BY THE OWNER: If the Contractor defaults or <br /> neglects to carry out the work in accordance with the contract documents or faifs to perform any provisions of <br /> the contract, the Community Development Division or#he Owner acting fhrough the Community Devefopment <br /> Division may, after seven (7) days' written notice, terminate this contract and finish the work by whatever <br /> method he deems expedlent. If the unpaid balance of the contract sum exceeds the expense of finishing the <br /> work, such excess shall be paid to the Contractor; but if such expense exceeds such unpaid balance, the <br /> Contractor shall pay the difference to the Owner or the Community Development Division. Failure fo pay the <br /> unpaid balance will result in disbarment from bidding on future Community Development Division projects. <br /> ARTICLE 14. » TERMINATION F CONTRACT BY THE C�NTRACTOR: If the Owner fails to <br /> perform any appficable provisions of the contract, the Contractor may, upon seven (7) days' written notice to <br /> the Owner and the Community Development Division, terminate the contract, and recover from the Owner <br /> payment for alI work satisfactorily completed and all other such remedies as are otherwise specified by law <br /> ARTICLE 15. -GENERAL CQNDITIONS: <br /> 15.1 The Work Write-Un shalE take precedence over the basic specification and, when in <br /> conflict, the material, equipment, ar workmanship called for in the "Work Write-Up"will <br /> be required. <br /> 15.2 The Drawinas of floor plans are diagrammatic only, illustrating the general intention of <br /> the Owner; they do not show all the work required, exact dimensions, or construction <br /> details. <br /> 15.3 The 2010 Bid Snecifications are detailed in a separate booklet available to the Owner <br /> and the Contractor from the Community Development Division. <br /> 15.4 Workmanshit� shall be done in accordance with the standard"s of the several trades <br /> knawn as a "workmanlike manner." <br /> 15.5 Materials shall be new, in good condition, and of standard grade unless otherwise <br /> agreed in writing before their delivery to the job. <br /> 'I5.6 Re airs shall be made by the Contractor to aH surtaces damaged by the Contractor <br /> resulting from his o� his subcontractor's work under this contract at no additionai cost <br /> to the Owner. Where "repair of existing work" is called for by the contract, the feature <br /> is to be placed in "equal to new condition" either by patching or replacement; all <br /> damaged, loose, or rotted parts shall be removed and rep{aced, and the finished work <br /> shail match adjacent work in design and dimension. <br /> 15.7 Bids or Proposals will be submitted at Bidder's risk and the Owne� or the Community <br /> Development Division reserves the right to reject any or all bids or proposals. All bids <br /> or proposals are to be typed -not hand written. <br /> 15.8 BufldinQ Codes-All work to be done shall be subject to the regulations af local building <br /> codes as interpreted by the applicable Cify or County bullding department/division <br /> whether or not covered by the spec�cations and drawings for the work. <br /> 15.9 Cleanun and removal from the site of atl debris and waste materials resulting from his <br /> work shall be the responsibility of the Contractor.
