ARTICLE 19. -INTEREST �F MEMBERS. OFFtCERS. EMPLOYEES OF PUBLIC BODY MEMBERS <br /> OF LOCAL GOVERNlNG BODY. OR OTHER PUBLIC OFFICIALS: No member, offic:er, or employse of <br /> Pasco County, or i#s designees or agents, no member of the governing body of the iacality in which the <br /> program is situated, and no other public official of such foca(ity or localities who exercises any functions or <br /> responsibilities with respect to the program during his tenure or for one (1) year thereafter, shall have any <br /> interest, direct or indirect, in any contract or subcontrac#, or the proceeds thereof, for wark to be performed in <br /> connecfion with the p�ogram assisted under the Contract. <br /> ARTICLE 20. - PROHIBITION OF BONUS OR COMMtSSION: The assistance provided under this <br /> Contract shal! not be used in payment of any bonus or commission for the purpose of obtaining County <br /> approvai of the appfication for such assistance. <br /> ARTICLE 21. -LOCAL EMPLOYMENT: To the greatest extent possible, the Contractor agrees to hire, <br /> train, and subconfract #o individua(s and firms that live or are located in Pasco County and the Tampa Bay <br /> Area. <br /> ARTICLE 22. - MINORITY AND WOMEN BUSINESS ENTERPRISE: To the greatest extent possible, <br /> the Contractor agrees that he will, if it is necessary, subcontract work to minority- and women-owned <br /> businesses. <br /> ARTICLE 23. — SECTION 3: HUD ACT OF 196$: The Section 3 preference requirement applies to <br /> any contract in excess of $100,Q00.00. The purpose of Section 3 is to ensure that employment opportunities <br /> generated by HUD financial assistance, shall to the greatest extent feasible, be directed to low- and very fow- <br /> income persons, particularly those who are recipienfs of govemment assistance for hausing artd to business <br /> concems that provide economic opportunities to low- and very !ow-income persons. If this contract is in <br /> excess of$100,000.4(3 the following language is applicabie, and shall be included in any subcontracts: <br /> Section 3 Clause: All section 3 contracts shall include the following clause (referred to as the 5ection 3 <br /> Clause): <br /> 23.9 The work to be perFormed under this contract is subject to the requirements of Section 3 of the <br /> Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701u. Section 3 <br /> requires that, to the greatest extent feasible, opportunities for training and employment be given <br /> lower-income residents of the project area, and contracts for work in connection with the project <br /> be awarded to business concems, which are iocated in or owned in substantial part by persons <br /> residing fn the area of the project. <br /> 23.2 The parties to this contract agree to comply with HUD's regulations in 24 Part C�R 135, and all <br /> applicable rules and orders of the Department issued thereunder prior to the execution of this <br /> contract. As evidenced by their execution of this contract, the parties to this contract certify that <br /> they are under no contractual or other impediment, which would prevent them from complying <br /> with the Part 136 regulations. <br /> 23.3 The contractor agrees ta send to each labor organization or representative of workers with <br /> which the contractor has a collective bargaining agreement or other contract or understanding, if <br /> any, a notice advising the labor organization or workers' representative of the contractor's <br /> commitments under this Section 3 Clause and shall post copies of the notice in conspicuous <br /> places at the work site where both employees and applicants for training and employment <br /> positions can see the notice. The notice shall descrii�e the Section 3 preference, shall set forth <br /> minimum number and job titles subject to hire, availability of apprenticeship and training <br /> positions, the qualifications for each; and the name and location of #he person(s) taking <br /> applications for each of the positions; and the anticipated date the work shall begin. <br /> 23.4 The contractor agrees to include this Section 3 Clause in every subcont�act for work in <br /> connection with the project and agrees fo take appropriate action, as provided in an applicable <br /> S/Community De�lopmentlHousing Fortns Revised 04/27/11 <br /> -7- <br />
