15.10 Trade Names are used in the basic specification to establish quality and type of <br /> ma#erial required; exact material to be used on a specific property will be described in <br /> the "Work Write-Up"for the particular property. <br /> 15.19 Adjacent Pro�ertv- When adjacent property is affected or endangered by any work <br /> done under this contract, it shall be the responsibility of the Contractor to take <br /> wnatever steps are necessary for the protection of the adjacent property and to notify <br /> the Owner thereof of such hazards. <br /> 15.12 Pavrofl Records of employee's hours worked and wages paid on construction jobs <br /> shall be made available to the Community Development Division, if requested. <br /> 15.13 The Use of Lead-Based Paint on applicable surtaces of any residential structure <br /> undergoing Federaily assisted construction or construction under any program wi#h <br /> federal assistance is prohibited. Any surface which contains lead-based paint shall be <br /> considered an immediate health hazard. <br /> 15.14 The recognized amount of the contract is the Proposal page of the Bid, which is signed <br /> by the Contractor. The prices that are detailed in the work write-up are for information <br /> only. <br /> ARTICLE 16. - ARBITRATION; The Con#ractor and Owner agree, that in cases of apparent <br /> irrecpncilable differences arising in connection with contracf pertormance or terms af the contract during the <br /> progress of the construction, to submit the mafter to #he Community Development Division fo� binding <br /> arbitration. <br /> ARTlCLE 17. - LIEN WAIVERS: Contractor agrees to protect, defend, and indemnify the Community <br /> Development Division and the Owner frorn any claims for unpaid work, labor, or materials with respect to <br /> Contractar's performance. Final payment shall not be due until the Contractor has delivered to the Owner, in <br /> care of Community Deveiopment Division, complete release of all liens for work completed arising out of <br /> Contractor's performance or a receipt in full covering all iabor and mate�ais for which a lien could be filed or a <br /> bond satisfactory to the Owner indemnifying him against any tien. All notice to owners must have a release of <br /> lien for final payment. {Form Enclosed in Contract). <br /> ARTICLE 18. - PROHIBlTtON OF K[CKBACKS: The Contractor nor any of its officers, partners, <br /> owners, agents, representatives, employees, or parties in interest has in any way colluded, conspired, <br /> connived, or agreed, directly o� indirectly with any other Bidder, firm, or person to submit a collusive or shall <br /> Bid in connectian with the Contractor for which the attached Bid has been submitted or to refrain from bidding <br /> in connection with such contract, or has in any manner, direc#ly or indirectly, sought by contract or collusion or <br /> communication ar conference with any other Bidder, firm, or person t�fix any overhead, profit, or cos#efement <br /> of the Bid price or the Bid price of any other Bidder, or to secure through any callusion, conspiracy, <br /> connivance, or unlawful contract, any advantage agair�st the Pasco County Community Development Division, <br /> or any person interested in the proposed contract; and, <br /> The price or prices quoted are fair and proper and are not tainted by any collusion, conspiracy, <br /> connivance, or unlawful contract on the part of the Bidder or any of its agents, representatives, owners, <br /> employees, or parties in interest, including this affiant. <br /> S/Community DevefopmentlHousing Fortns Revised 04/27/11 <br /> _g_ <br />
