ARTlCLE 13. - TERMINATlON OF CONTRACT BY TH� OWNER: If the Contractor defaults or <br /> neglects to caRy out#he work in accordance with the contract documents or faiis to perform any provisions of <br /> the contract, the Community Development Division or the Owner acting through the Community Development <br /> Division may, after seven (7) days' written notice, ferminate this contract and finish the work by whatever <br /> method he deems expedient. If the unpaid balance of the contract sum exceeds the expense of finishing the <br /> work, such excess shall be paid to the Contractor; but if such expense exceeds such unpaid balance, the <br /> Contractor shall pay the difference to the Owner or the Community Development Division. Failure to pay the <br /> unpaid balance will result in disbarment from bidding on future Community Deveiopment Division projects. <br /> ARTtCLE 14. - TERMINATION OF CONTRACT BY THE CONTRACTOR: If the Owner fails to <br /> perform any applicable provisions of the contract, fhe Contractor may, upon seven (7} days' written notice to <br /> the Owner and the Community Devefopmenf Division, terminate the contract, and recover from the Owner <br /> payment for all worK satisfactori(y completed and alI other such remedies as are otherwise specified by►aw <br /> ARTICLE 15. -GENERAL CONDITIONS: <br /> 15.1 The Work Write-U shall take precedence over the basic specification and, when in <br /> cflnfiict, the material, equipment, or workmanship called for in the "Work Write-Up"will <br /> be required. <br /> 15.2 The Drawinc�s of floor plans are diagrammatic only, iflustrating the general intention of <br /> the Owner; they do not show all the work required, exact dimenslans, or construction <br /> details. <br /> 15.3 The 2010 Bid Specifications are detailed in a separate booklet available ta the Owner <br /> and the Contractor from the Community Developmen#Division. <br /> 15.4 Workmanship shall be done in accordance with the standards of the several trades <br /> known as a"workmanlike manner." <br /> 15.5 Materials shall be new, in good condition, and af standard grade unless otherwise <br /> ag�eed in wrifing before their de(ivery to the job. <br /> 15.6 Re airs shall be made by the Contractar to all surtaces damaged by the Contractor <br /> resulting from his or his subcontractor's work under this contract at no additional cost <br /> to the Owner. Where "repair of exis#ing work" is ca[led fo� by the contract, the feature <br /> is to be placed in "equaf to new condi#ion" either by patching or replacement; aff <br /> damaged, loose, or rotted parts shall be removed and replaced, and the finished work <br /> shall match adjacent wo�k in design and dimension. <br /> 15.7 Bids or Pronosals will be submitted at Bidder's risk and the Owner or the Community <br /> Development Division reserves the right to reject any or all bids or proposals. All bids <br /> or proposals are to be typed -not hand written. <br /> 15.8 Buildinca Codes -AI! work to be done shall be subject to the regulations of local building <br /> codes as interpreted by the applicable City or County building department/division <br /> whether or not covered by the speciftcations and drawings for the work. <br /> 15.9 Cleanua and removal from the site of all debris and waste materials resulting from his <br /> work shalf be the responsibility of the Contractor.
