� ARTICLE 19. - iNTEREST OF MEMBERS. OFFlCERS, EMPLOYEES OF PUBLIC BODY MEMBERS <br /> OF LOCAL GOVERNING B�DY. OR OTHER PUBLIC OFFICIALS: No member, officer, or employee of <br /> Pasco County, or its designees or agents, no member of the governing body of the locality in which the <br /> program is situated, and no other public official of such locality or localities who exercises any functions ar <br /> responsibilities with respect to the program during his tenure or for one(1) year thereafter, shall have any <br /> interest, direct or indirect, in any contract or subcon#ract, or the proceeds thereof, for woric to be pertormed in <br /> connec#ion with the program assisted under the Contract. <br /> ARTICLE 20. - PROH1BiTION OF BONUS OR COMMISStON: The assistance provided under this <br /> Contract shall not be used in payment of any bonus or commission fo� the purpose of obtaining County <br /> approval of the applicatian for such assistance. <br /> ARTICLE 29. -LOCAL EMPLOYMENT: To the greatest extent possible, the Contractor agrees to hire, <br /> train, and subcantract to individusts and firms that live or are focated in Pasco County and the Tampa Bay <br /> Area. <br /> ARTICLE 22. - MINORtTY AND WOMEN BUSINESS ENTERPRISE: To #he greatest extent possible, <br /> the Contractor agrees that he wil1, if it is necessary, subcontract work to minoritar- and women-owned <br /> businesses. <br /> ARTICLE 23. — SECTION 3: HUD ACT OF 1968: The Section 3 preference requirement applies tn <br /> any cont�act in excess of $'Id0,000.00. The purpose of Section 3 is to ensure that emp(oyment opportunities <br /> generated by HUD financial assistance, shall to the greates# extent feasible, be directed to law- and very low- <br /> income persons, particularly those who are recipients of govemment assistance for housing and to business <br /> concems that provide economic opportunities to low- and very (ow-income persons. If this contract is in <br /> excess of$100,000.00 t�e following language is applicable, and shall be included in any subcontracts: <br /> Section 3 Clause: All section 3 contracts shaq include the following clause (referred to as the Section 3 <br /> Clause): <br /> 23.1 The work ta be performed under this contract is subject to the requirements of Section 3 of the <br /> Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701u. Section 3 <br /> requires that, to the greatest extent feasible, opportunities for training and employment be given <br /> lower-income residents of the project area, and cantracts for work in connection with the project <br /> be awarded to business concerns, which are located in or owned in substantial par� by persons <br /> residing in the area of the praject. <br /> 23.2 The parties to this contract agree to comply with HUD's regulations in 24 Part CFR 135, and al! <br /> applicable rules and orders of the Department issued thereunder prior to the execution of this <br /> contrac#. As evidenced by their execution of this contract, the parties to this contract certify that <br /> they are under no contractual or other impediment, which would prevent them from complying <br /> with the Part 135 �egulations. <br /> 23.3 The contractor agrees to send to each labor organization or representative of workers with <br /> which the contractor has a collective bargaining agreement or otlier cantract or understanding, if <br /> any, a notice advising the labor organization or workers' representative of the contractors <br /> commitments under this Section 3 Clause and shall post copies of the notice in conspicuous <br /> places a# the work site where both employees and applicants for training and employment <br /> positions can see the notice. The notice shafl describe the Section 3 preference, sha(I set forth <br /> minimurn number and job titles subject to hire, availability of apprenticeship and training <br /> positions, #he quali�cations for each; and the name and location of the person{s) taking <br /> applications for each of the positions; and the anticipated date the work shal! begin. <br /> 23.4 The contractor agrees to include this Section 3 Clause in every subcontract for work in <br /> connection with the project and agrees to take appropriate action, as provided in an applicable <br /> S/Communtty Development/Housing Forms Revised 04/27/11 <br /> - 7- <br />
