1�.10 Trade Names are used in #he basic specification to establish quali#y and type of <br /> rtiaterial required; exact material to be used on a specific property wfil be described in <br /> the"Work Wrfte-Up"for the particufar property. <br /> 15.11 Adiacent Propertv- When adjacent property is affec#ed or endangered by any work <br /> done under this confract, it shall be the responsibility of the Contractor to take <br /> whatever steps are necessary for the protection of the adjacent property and to notify <br /> the Owner thereof of such hazards. <br /> 15.12 Pavroll Records of employee's hours worked and wages paid on construc#ion jobs <br /> shall be made available to the Community Development Division, if requested. <br /> 15.13 The Use of Lead-Based Paint on applicable surFaces of any residential structure <br /> undergoing Federally assisted construction or construction under any program with <br /> federal assistance is prohibited. Any surface which contains lead-based paint shall be <br /> considered an immediate health hazard. <br /> 15.14 The recognized amount of the contract is the Praposal page of the Bid, which is signed <br /> by the Contractor. The prices fhat are detailed in the work write-up are for information <br /> only. <br /> ARTICLE 16. - ARBITRATION: The Contrador and Owner agree, that in cases of apparent <br /> irreconcilable differences arising in connection with contract performance or terms of the contract during the <br /> progress of #he construction, to submit the matter to the Community Development Divisivn for binding <br /> arbitration. <br /> ARTfCLE 17. - LIEN WAIVERS: Contractor agrees to protect, defend, and indemnify the Community <br /> Development Division and the Owner from any claims for unpaid work, labor, or materials with respect to <br /> Contractor's performanc�. Final payment shal! not be due until the Contractor has delivered to the Owner, in <br /> care of Community Devefopmen# Division, camplete release of all liens for work completed arising ou# of <br /> Contractor's performance or a receipt in fuli covering all labor and materials for which a lien could be filed or a <br /> bond satisfactory to the Owner indemnifying him against any lien. All notice to owners must have a release of <br /> lien for final payment. (Form Enclosed in Contract}. <br /> ARTICLE 18. - PROHIBITION OF KICKBACKS: The Contractor nor any of its officers, partners, <br /> owners, agents, representatives, employees, or parties in interest has in any way colluded, conspired, <br /> connived, or agreed, directly or indirectly with any other Bidder, firm, or person to submit a collusive or shall <br /> Bid in connection with the Contractor for which the attached Bid has been submi#ted or to refrain from bidding <br /> in connection wi#h such contract, or has in any manner, directly or indirectly, sought by contrac#or collusion or <br /> communication or conference with any other Bidder, firm, or person to fix any ove�head, profit, or cost element <br /> of the Bid price or the Bid price of any other Bidder, or to secure through any collusion, conspiracy, <br /> connivance, or uniawful contract, any advantage against the Pasco County Community Development Division, <br /> or any person interested in the proposed contract; and, <br /> The price or prices quoted are fair and prvper and are not tainted by any collusion, conspiracy, <br /> connivance, ar unlawful contract on the part of the Bidder or any of its agents, representatives, owners, <br /> employees, or parties in interest, including this affiant. <br /> S/Communiry DevelopmenUHousing Forms Revised 04/27/it <br /> -$- <br />
