ARTtCLE 13. - TERMINA'TION OF CONTRACT BY THE OWNER: If the Contractor defaults or <br /> neglects to carry out the work in ac�ordance with the contract documents or faifs to pertorm any provisions of <br /> the contract, the Community Development Division or the Owner acting through the Community Development <br /> Division may, after seven {7) days' written noNce, terminate this contract and finish the work by whatever <br /> method he deems expedient. If the unpaid balance of the contract sum exceeds the expense of finishing the <br /> work, such excess shafl be paid to the Contractor; but if such expense exceeds such unpaid balance,the <br /> Contractor shall pay the difference to the Owner or the Community Development Division. Failure to pay the <br /> unpaid balance will result in disbarmenf from bidding on future Community Development Division projects. <br /> ARTICLE 14. - TERMINATION OF CONTRACT BY THE CONTRACTOR: If the Owner fails to <br /> perform any applicable provisions of the contract, the Contractor may, upon seven (7) days' written notice to <br /> the Owner and the Community Develapment Division, terminate the contract, and recover from the Owner <br /> payment for all work satisfactorily completed and all other such remedies as are otherwise specified by law <br /> ARTICLE 15. -GENERAL CONDITIONS: <br /> 15.1 The Wor{c Write-Up shall take precedence over the basic specification artd, when in <br /> conflic#, the material, equipment, or workmanship called for in the"Work Write-Up"wifl <br /> be required. <br /> 15.2 The Drawinas of floor plans are diagrammatic on1y, illustrating the general intention of <br /> the Owner; they do not show al! the work required, exact dimensions, or construction <br /> details. <br /> 15.3 The 2a10 Bid Specifications are detailed in a separa#e booklet availabie to the Owner <br /> and the Contractor from the Community Deveiopment Division. <br /> 95.4 Workmanship shall be done in accordance with the standards of the several trades <br /> known as a "workmanlike manner." <br /> 15.5 Mate�ials shall be new, in good condition, and of standard grade unless otherwise <br /> agreed in writing b�fore their delivery to the job. <br /> 15.6 Repairs shall be made by the Contractor fo all surfaces damaged by the Contractor <br /> resulting from his or his subcontrac#or's work under this contract at no additional cos# <br /> to the Owner. Where "repair of existing work" is called for by the cantract, the feature <br /> is to be placed in "equal to new condition" either by patching or replacement; all <br /> damaged, loose, or rotted parts shall be removed and replaced, and the finished work <br /> shall match adjacent work in design and dimension. <br /> 15.7 Bids or Proaosals will be submitted at Bidder`s risk and the Owner ar the Community <br /> Development Division reserves the right ta reject any or all bids or proposals. All bids <br /> or proposals are to be typed-not hand written. <br /> 15.8 Buildinq Codes-All work to be done shall be subject to the regulations of local building <br /> codes as interpreted by the applicable City or County building department/divisian <br /> whether or no# covered by the specifications and drawings for fhe work. <br /> 15.9 Cleanup and removal from the site of all debris and waste materials resulting from his <br /> work shall be the responsibility of�he Contractor.
