<br />each to the other for the purpose of the construction of a
<br />single-family residence. The Contractor shall perform all the
<br />work required by the contract documents to construct, finish,
<br />and deliver to the Owners a residence on land owned by the Own-
<br />ers, said land specifically described as:

<br />Said residence shall be constructed in accordance with the con-
<br />tract plans and specifications, and other conditions that may be
<br />contained within this document. However, if any discrepancies
<br />appear between the plans and the conditions and specifications
<br />as presented here by the Contractor, it is understood that the
<br />Contractors specifications and conditions shall govern.
<br />
<br />1. CONTRACT SUM. The Owners promise and agree with the Con-
<br />tractor that they will, In consideration of agreements being ex-
<br />ecuted and performed by the Contractor as specified, payor
<br />cause to be pai d to tile Contractor the sum of$..!()),J..QQ.~QQ............. as
<br />the Contract Sum. Funds will become due and shall be paid to the
<br />Contractor in accordance with typical financial institution con-
<br />struction disbursement schedule. The total Contract Sum shall be
<br />received by the Contractor prior to issuance of a Certificate of
<br />Occupancy.
<br />
<br />2. CONSTRUCTION CHANGE ORDERS. Any changes to the agreed docu-
<br />ments, plans, or specifications, requested by the Owners shall
<br />be submitted in writing to the Contractor and may be subject to
<br />cost revisions. Any additional change cost shall be paid to the
<br />Contractor at the time such changes are performed.
<br />
<br />'3. It is agreed between Contractor and Owners that if the plans
<br />provided for construction are deficient of any Code requirements
<br />resulting in any additional cost of construction, the Owners
<br />shall bear the additional reasonable cost of the requirements
<br />for Code compliance.
<br />
<br />4. Contractor agrees to visible inspect soil conditions at the
<br />time of foundation preparation. However, if any underlying soil
<br />conditions are determined to be unsuitable for foundation sup-
<br />port, the Owners agree not to hold the Contractor responsible.
<br />if soil test boring is required, the Owners shall bear all cost
<br />of such test and additional cost required for corrective founda-
<br />tion work.
