<br />-- <br /> <br />r~r " "' <br /> <br />~..~ - <br /> <br /> <br />" <br /> <br />All damages to or by livestock and claims and demands with respect <br />thereto including all damages caused as a result of fences, gates, and <br />gaps left open or insecurely closed. .. <br /> <br />Protection of Work and Materials: Facilities for handling of material and <br />inspecting the work shall at all times be furnished by the Contractor, and <br />all costs due to delays in handling of materials or equipment, and loss or <br />damage, shall be at the expense of the Contractor. The Contractor shall <br />be responsible for all materials, equipment and supplies sold and <br />delivered to the City until final inspection of the work and acceptance <br />thereof by the City. In the event any such materials, equipment and <br />supplies are lost, stolen, damaged or destroyed prior to receipt of <br />delivery, Contractor shall replace same without cost to the City, <br /> <br />Permits and Pr9tection of Public: The Contractor shall be required to <br />obseNe cd' the ordinances in relation to obtaining permits for occupying, <br />excavating or in anywise obstructing the streets and alleys, He shall erect <br />and maintain barricades and sufficient safeguards around all <br />excavations, embankments or obstructions, <br /> <br />Where there are telephone, telegraph, light or power poles; water mains, <br />conduits, pipe, or drains; or other construction either publiC or private; in <br />or on the streets or alleys; the work shall be so conducted that no <br />interruption or delay will be caused in the operation or use of the same. <br />Proper written notice shall be given and all the facilities afforded the <br />owners of such construction encountered or likely to be encountered, as <br />will enable them to preseNe the same from injury. <br /> <br />Decisions in Disagreements: The Engineer will be the interpreter of the <br />terms and conditions of the ContraGt Documents and the judge of the <br />performance thereunder. In his capacity as Interpreter and judge, he will <br />exercise his best efforts to ensure faithful performance by both the City <br />and the Contractor, He will not show partiality to either and shall not be <br />liable for the result of any interpretation or decision rendered in good <br />faith, Claims, disputes and other matters relating to the execution and <br />progress of the work or the Interpretation of or performance under the <br />. Contract Documents shall be referred to the Engineer for decision; which <br />he will render in writing within a reasonable time. <br /> <br />f" ,. <br /> <br />Changes in the Work: Without invalidating the Agreement, the City may, <br />at any time or from time to time, order additions, deletions, or revisions in <br />the work; these will be authorized by Change Orders.
