1111111IIIII I111I1118IiIIi11111111111111111111111111111iIII <br /> 2004055871 <br /> Rcpt: 769139 Rec: 10.50 <br /> ORDINANCE NO. 866-04 0S: 0.00 IT: 0.00 <br /> 03/30/04 _ Opty Clerk <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE <br /> CITY OF .ZEPHYRHILLS, FLORIDA AMENDING <br /> AND SUBSTANTIALLY REWORDING SECTION <br /> 4234 OF THE LAND DEVELOPMENT CODE, CLEAR <br /> SITE TRIANGLE; PROVIDING FOR VISIBILITY AT <br /> INTERSECTIONS; PROVIDING FOR DISTANCE <br /> REQUIREMENTS FOR VARIOUS SPEED LIMITS; <br /> PROVIDING FOR CONFLICT; PROVIDING FOR <br /> REPEALER, SEVERABILITY, INCLUSION IN <br /> CODE, AND AN EFFECTIVE DATE JED PITTMRN , PRSCO COUNTY CLERK <br /> 03/30/04 11:25am 1 X59 2 <br /> 1595 <br /> 8K <br /> 5785 G 5 <br /> WHEREAS, the City of Zephyrhills previously adopted clear site triangle regulations as part of <br /> the Land Development Code; and <br /> WHEREAS, the City has undergone tremendous development and growth over the past decade; <br /> and <br /> WHEREAS, the City Council has determined that the City's clear site triangle requirements <br /> should be updated to include all road types in accordance with the Florida Department of <br /> Transportation's (FDOT) Manual of Minimum Standards for Design, Construction and <br /> Maintenance for Streets and Highways. <br /> NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills, <br /> Florida, as follows: <br /> SECTION 1. <br /> Section 4234 of the Land Development Code, Clear Site Triangle, is hereby amended as follows: <br /> Section 4234. Clear Site Triangle. <br /> In order to provide a clear view of intersecting streets to the motorist, there shall be a triangular <br /> area of clear visibility formed by two intersecting streets or the intersection of a driveway and a <br /> street. Nothing in excess of 3.5 feet in height including but not limited to fences, buildings, <br /> walls, and vegetation, shall be erected, placed, parked, planted or allowed to grow in such a <br /> manner as to materially impede vision within the clear site triangle area. The following <br /> standards shall be met: <br /> A. On the intersection of local streets with speed limits not exceeding 30 mph with stop- <br /> sign control on all approaches, the clear site triangle shall be determined as beginning <br /> at the intersection of street rights -of -way (edge of pavement), projected where <br /> rounded, then in each direction along adjoining property for a distance of 15 feet, and <br /> then in a straight line across the property. For approaches at intersections without <br /> stop -sign control on all approaches, the minimum required site distance is 200 feet. <br /> B. On the intersection of streets with speed limits exceeding 30 mph, the site distance <br /> requirement established in the Florida Department of Transportation's (FDOT) <br /> Manual of Minimum Standards for Design, Construction and Maintenance for Streets <br /> and Highways (2002), as amended. <br /> The above provisions shall not apply to the intersection of an alley and a street. At each <br /> intersection of an alley and street, each landowner must maintain a setback of no less than 10 feet <br /> from right -of -way of streets and alleys. The setback area must be maintained free from sight <br /> obstruction by vehicles, walls, fences, plants, landscaping materials, or other opaque objects in <br /> excess of 3.5 feet above the abutting roadway. <br /> Record and Return to: <br /> City Clerk's Office <br /> 5335 8th Street <br /> Zephyrhills, FL 33542 <br />
