Contract Provisions and Exclusions (con�) <br /> interior property that Customer did not remove or protect prior to commencement and during the <br /> course of roofing tear-off and re-roofing operations. Customer shall notify tenants and building <br /> occupants of re-roofing and the need to provide protection underneath areas being re-roofed. <br /> Customer agrees to hold Jurin Roofing Services, Inc. harmless from claims of tenants and occupants <br /> who were not so notified and did not provide protection. <br /> 6.9 Jurin Roofing Services, Inc. shall furnish the labor and materials necessary to perform the work <br /> described herein or in the referenced contract documents. Jurin Roofing Services, Inc. is not a <br /> licensed architect or engineer and does not provide architectural, engineering or consulting services. It <br /> is the owner's responsibility to retain a licensed architect or engineer to determine structural integrity <br /> and proper design, including that the design is in compliance with applicable ordinances, codes and <br /> regulations. If plans, specifications or other design documents have been furnished to Jurin Roofing <br /> Services, Inc. customer warrants they are sufficient and conform to all applicable laws and building <br /> codes. Jurin Roofing Services, Inc. is not responsible for any loss, damage or expense due to defects <br /> of plans or specifications or building code violations unless such damage results from a deviation by <br /> Jurin Roofing Services, Inc. from the contract documents. Customer warrants all structures to be in <br /> sound condition capable of withstanding normal activities of roofing construction equipment and <br /> operations and the work that is to be performed. Jurin Roofing Services, Inc. is not responsible for <br /> location of roof drains, adequacy of drainage or ponding on the roof. <br /> 6.10 This proposal is being submitted based upon standard roofing practices with the intention of providing <br /> long-term moisture protection. No consideration has been given to local building code requirements. <br /> Change to the specifications may be required in order to comply with local codes. Any changes to this <br /> scope of work in order to comply with code requirements will be considered a change order to the <br /> project. <br /> 6.11 Owner warrants that the structures on which Jurin Roofing Services, Inc. is to work are in sound <br /> condition and capable of withstanding normal activities of roofing construction equipment and <br /> operations. Owner represents that there is no electrical conduit embedded in the existing roofing or <br /> attached directly to the underside or topside of the roof deck upon which Jurin Roofing Services, Inc. <br /> will be installing the new roof. Owner will indemnify Jurin Roofing Services, Inc. from any personal <br /> injury, damage, claim or expense due to unsafe structural conditions and the presence of electrical <br /> conduit, shall render the conduit harmless so as to avoid injury to Jurin Roofing Services'personnel, <br /> and shall compensate Jurin Roofing Services, Inc. for additional time and expense resulting from the <br /> presence of such materials and unsafe structures. <br /> 6.12 Design Professional is responsible to design the work to be in compliance with applicable codes and <br /> regulations and to specify or show the work that is to be performed. Jurin Roofing Services, Inc. is <br /> not responsible for design, including calculation or verification of wind load design. To the extent <br /> minimum wind loads or pressures are required; Jurin Roofing Service, Inc.'s bid is based solely on <br /> manufacture's printed test results.
